Terms and Conditions for The Explore Pass
These Terms and Conditions (“Agreement”) govern the use of The Explore Pass (“Pass”) provided by [Business Name] (“Company,” “we,” “our,” or “us”) for access to various local venues and attractions (“Venues”). By purchasing, receiving, or using the Pass, you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, do not purchase or use the Pass.
1. Description of The Explore Pass
1.1. The Explore Pass is a 12-month family activities access pass to a variety of local venues and attractions, which are identified on this website. Your Explore Pass becomes active on the date of your purchase.
2. Pass Benefits
2.1. The Explore Pass grants access to participating local venues and attractions (“Participating Venues”), subject to the terms set forth in this Agreement.
2.2. The Pass does not guarantee entry to any Venue if the Venue is at capacity, closed, or otherwise unavailable on the day of the visit. Customers are encouraged to check with the Venue for availability before attending.
3. Usage
3.1. Your pass must be presented at each Participating Venue to gain access.
3.2. The Explore Pass does not cover additional charges such as parking, food and beverage, special events, merchandise, or any other additional services or amenities at Participating Venues, unless otherwise outlined.
3.3. Some Participating Venues may have specific restrictions or guidelines, such as age limits, height restrictions, or special hours. It is the Customer’s responsibility to familiarize themselves with these restrictions before visiting.
4. Restrictions and Limitations
4.1. The Pass is non-transferable and cannot be sold, rented, or transferred to third parties.
4.2 Any misuse of the Pass, including but not limited to fraudulent activity, violation of Venue rules, or attempts to transfer the Pass inappropriately, may result in the termination of the Pass and forfeiture of all benefits without refund.
5. Termination and Cancellation
5.1. We reserve the right to terminate or suspend your access to the Pass at any time if we determine that you have violated these Terms and Conditions.
5.2. Refunds may be issued within 30 days of purchase provided the pass has not been used at any participating venues.
5.3. If a Participating Venue withdraws from the program, we will make reasonable efforts to notify the Customer but are not responsible for any inconvenience caused by such withdrawal. All current Explore Pass holder will be entitled to participate in all new venues or attractions which may become participants in The Explore Pass subsequent to current Explore Pass holder’s purchase.
6. Liability and Disclaimers
6.1. To the fullest extent permitted by law, The Explore will not be held liable for any injury, loss, damage, or other claims arising from the use or inability to use the Pass, including at Participating Venues.
6.2. We make no representations or warranties about the availability, quality, or safety of any Participating Venues. Any issues or disputes related to a Venue visit should be addressed directly with the Venue in question.
7. Privacy
7.1. By purchasing or using The Explore Pass, you consent to the collection and use of your personal information as outlined in our Privacy Policy. This may include information necessary to process your purchase, verify eligibility, or communicate updates regarding the Pass and Participating Venues.
8. Assumption of Risk
8.1. Voluntary Participation
By purchasing and using The Explore Pass, you acknowledge and agree that your participation in activities at Participating Venues involves certain inherent risks, including but not limited to physical injury, property damage, or other harm. You voluntarily assume all risks associated with the use of the Pass and participation in activities at the Venues.
8.2. Health and Safety
You are responsible for ensuring that all family members using The Explore Pass are in good health and capable of participating in the activities at the Participating Venues. We strongly recommend that you consult a medical professional before engaging in any physical activities. It is your responsibility to monitor your health and safety while using the Pass.
8.3. Indemnification
You agree to indemnify, defend, and hold harmless The Explore Pass LLC, its employees, agents, and partners from any and all claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising from or related to your participation in activities at Participating Venues or the use of The Explore Pass.
8.4. Release of Liability
To the fullest extent permitted by law, you hereby release and discharge The Explore Pass LLC, its affiliates, employees, and agents from any and all liability for personal injury, death, property damage, or other loss sustained by you during the use of The Explore Pass or participation in activities at the Participating Venues.
9. Modifications to Terms
9.1. We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website or notifying Customers by email. It is your responsibility to review these Terms periodically to stay informed about any changes.
10. Governing Law
10.1. These Terms and Conditions are governed by the laws of the state of Minnesota without regard to its conflict of law principles.
